Tactyl Pty Ltd ACN 689 549 102, located at 35/477 Collins Street, Melbourne, Victoria Australia 3000 (hereinafter referred to as "we", "us", or "our"), operates an AI-driven platform designed to support the generation, refinement, and progression of business ideas, concepts, and designs, together with any related software tools and/or web-based links (collectively, the "Platform"). The Platform exists to help transform early-stage concepts and preliminary thinking into actionable outcomes.
1.2. The Platform has been built to leverage and integrate the strategic capabilities of established AI systems, including ChatGPT, Claude, Gemini, and xAI, and delivers responses derived exclusively from your submitted information (Inputs).
2. Account Creation, Access, and Agreement
As outlined in our Terms:
2.1. Access to the Platform requires that you are no younger than thirteen (13) years of age. If you are below the age of legal majority in your country of residence (which may be eighteen (18) or twenty-one (21) years of age), you may only use the Platform under the direct supervision of a parent or legal guardian.

(b) while we recognise that learning from real-world usage is a vital element of developing and deploying increasingly safe AI systems, we cannot anticipate every beneficial or abusive application of our technology, and we will actively monitor for emerging abuse patterns.
This policy will be revised as we learn over time.
4. Overarching Standards
4.1. To foster innovation and creativity, you should have the freedom to use the Platform at your discretion, provided always that you comply with applicable law and do not cause harm to yourself or others.
4.2. Causing harm to others and compromising the privacy of others encompasses, but is not limited to (and the following is not intended to be an exhaustive list):
(a) engaging in regulated activities without adhering to applicable laws and/or regulations;
(b) collecting, processing, disclosing, deriving inferences from, or generating personal data without satisfying applicable legal requirements;
(c) using, accessing, creating, and/or deploying spyware, communications surveillance tools, or unauthorised monitoring of individuals or organisations;
(d) promoting or participating in any unlawful activity, including the exploitation or endangerment of children, and the development or distribution of illegal substances, goods, or services;
(e) developing a product or service directed at minors;
(f) employing subliminal, manipulative, or deceptive methods that alter a person's behaviour such that they are unable to make informed decisions, or exploiting vulnerabilities related to age, disability, or socio-economic status;
(g) building or expanding facial recognition databases without consent and/or performing live remote biometric identification for any purpose;
(h) where your Inputs suggest or indicate that you are assessing or categorising individuals on the basis of their social conduct or personal characteristics (including social scoring or predictive profiling) that leads to disadvantageous or unfavourable treatment or any other form of profiling for an inappropriate purpose;
(i) classifying individuals on the basis of their biometric data to deduce or infer sensitive characteristics such as race, political views, religious convictions, or sexual orientation;
(j) delivering any services — including legal, medical/health, or financial guidance — without review by a qualified professional and clear disclosure of the use of AI assistance along with its potential limitations;
(k) facilitating real-money gambling or payday lending; and/or
(l) producing sexually explicit or suggestive material.
5. AI Technology Usage
5.1. As the website and the Platform afford you the flexibility to develop your own Content, you — as the developer — bear responsibility for how you design and implement your interactions and for any risks to third parties that may arise.
5.2. This encompasses situations where you create a product or service using the website, the Platform, and/or the Content, which may or does cause harm or risk to others, including compromising others' privacy.
5.3. Without limiting the Terms:
(a) you agree and acknowledge that you will not use or misuse the website, the Platform, or the
Content, and that any product or service you develop using the website, the Platform, and/or the
Content must not:
(i) contravene any laws;
(ii) cause harm to others or compromise the privacy of others (interpreted in the broadest sense);
(iii) misinform, misrepresent, or deceive others; and
(b) you agree to indemnify and hold us harmless, to the fullest extent permitted by law, from any breach of this policy (as amended from time to time).
6. Termination and Breach
6.1. A breach of this policy constitutes misconduct, and we may rely on the relevant provisions of the Terms concerning termination. We retain the right, without advance notice, at all times to suspend or terminate access to the website and the Platform in such circumstances.
6.2. We report apparent child sexual abuse material to the International Centre for Missing & Exploited Children Australia or the equivalent body in the relevant jurisdiction.
